Please read the terms and conditions ("Terms and Conditions") set out below carefully before ordering food on the train from our Website. By ordering any Goods or Services from this Website, by phone, or by our mobile applications, or SMS or Email or Chat you agree to be bound by these Terms and Conditions.

  • 1.1 Introduction :- At the time of Ordering any type of Products or Services from our Website, Mobile Application, Email, SMS, Chat or through call, You agree and acknowledge to be bound by these Terms and Conditions. Moreover, Our Products or Services are very different, so sometimes additional Terms & Conditions requirements may apply for some Products or Services. If you use those Products or Services then You agree to be bound those additional terms become part of your Agreement.
  • 1.2 Dibrail.com reserves the right to change, revise or Update Terms & Conditions policies at any time without any information. If you do not agree to all of these Terms and Conditions of use, please do not use Our Website or Application. Your continued usage of our Website or Application will mean you accept those changes.

Definitions

  • 2.1 "Website" “Site” means that our website is www.dibrail.com where we sell our Goods or Services.
  • 2.2 "App", "Mobile Application", "Application" means that our mobile application where we sell our Goods or Services.
  • 2.3 "we", "us", "our" & "Dibrail" are references to our Company (DIBRAIL SERVICES PRIVATE LIMITED).
  • 2.4 "You", "Your" & "Yours" means that you are the person who uses our website or mobile Application or any other channel provided by Dibrail to order any Goods or Services.
  • 2.5 "Goods" means any Goods which we can sell from our website or Mobile Application or any other channel provided by Dibrail.

  • 2.7 "Restaurant Partner" is a third party, which has agreed to Cooperate with us to Prepare & Deliver the Goods or Services.
  • 2.8 “Agreement” means these terms & Conditions, the Privacy Policy, any order form & Payment instructions provided to you.
  • 2.9 “Privacy Policy” means that the Privacy Policies showed on our Website which details How & Why we collect & store Your Personal Information.
  • 2.10 “Food Delivery in Train” means that Our Partner Restaurant takes full responsibility for any type of Perishable Goods or Delivery related Services.

Our Role

  • 3.1 Dibrail provides a communication system to the Partner Restaurants doing Food Delivery at different places and the person ordering the food.
  • 3.2 We have a number shown on our Website. We invite all customers to call and share their Feedback, Suggestion, Complaint, Problem or any Dispute in the Goods or Services received. You can also call and Change the order details or Cancel or Modify your Order.
  • 3.3 You may access some areas of this Website without creating any order or registering your personal details with us. because most areas of this website are open to everyone.
  • 3.4 Dibrail may Call, WhatsApp, send SMS or Email or use other all types of Online or offline possible methods for communicating with their customers or to take their Feedback.
  • 3.5 At the time of Accessing the Website, You are responsible for making all the necessary arrangements. You are also responsible for ensuring that all persons who access the website through your Internet connection are aware of these website Terms & Conditions and that they comply with them.
  • 3.6 At the time of using any part of this website, You agree that you accept all the Terms & Conditions. If you don't accept these Website Terms & Conditions, You may leave this website immediately.
  • 3.7 Dibrail.com reserves the right to change, revise or Update Terms & Conditions policies at any time without any information. If you do not agree to all of these Terms and Conditions of use, please do not use Our Website or Application. Your continued usage of our Website or Application will mean you Accept those changes. You are agreeing to be bound by the then current version of these Terms & Conditions of Use.

Ordering Goods or Services

  • 4.1 Supply of Food Delivery from this Website or Mobile App or through Call is between you and the Partner Restaurant But the Supply of Goods or Services from this Website or Mobile App or through Call or any contact is between you and Dibrail.
  • 4.2 You additionally warrant that all the information is Accurate and Complete at the time of ordering and payment details provided by you are your own and you have enough money to make the payment.
  • 4.3 At the time of Food Delivery in trains Goods & Services purchased by you from our website are only for personal use not for resale. You agreed that you are not an agent for another party and you will not use our Goods or Services for business purposes or any other purpose.
  • 4.4 It is Customer's responsibility to check & verify all the information & details they have entered that are correct or accurate at the time of ordering any errors before clicking on the "Order Now" button since once a customer clicks on this, an order ID is generated and input errors cannot be corrected.
  • 4.5 At the time of ordering you click on the Order Now button but after some times you decide that you don't want to proceed with your order then you should close the Website window or Mobile Application.
  • 4.6 If Customer Selects "COD (Cash On Delivery)" payment mode before clicking on the Order Now button, Dibrail will begin processing Your order and we will send you notification by SMS or Email that your order is being under processed. If Customer Selects "Online Payment" mode at the time of ordering, on receipt of your payment, Dibrail will begin processing your order and we will send you notification by SMS or Email that payment has been received and your order is being under processed. SMS and email confirmation will be produced automatically so that you have confirmation of your order details. You must inform us immediately if any details are incorrect. The fact that you receive an automatic confirmation does not necessarily mean that either we or the Delivery Restaurant will be able to fill your order.
  • 4.7 At the time of online payment, if any payment you make is not authorised you will be returned to the previous page on the Website and we shall not be obliged to provide the services.
  • 4.8 Please note that after you have made your order and your payment has been authorised then you will be able to Cancel your order according to our Cancellation Policy.
  • 4.9 On clicking the "Order Now" button, you explicitly agree to the Terms and Conditions set upon in this agreement. All orders placed through Dibrail will be deemed completed after the scheduled delivery time stated in the bill when the order is placed has passed, unless the customer notifies the customer service agent about the non delivery of their order.

Price and Payment

  • 5.1 Prices will be quoted on this Website. These prices are inclusive of relevant sales tax, Dibrail service charges and delivery charges. In case Delivery Restaurants require a service charge (for instance for orders below the minimum order amount), this will be clearly indicated on this Website, in the itemised bill, and added to the total amount due.
  • 5.2 This Website contains a large number of menu items. Although we take great care to keep them up to date, it is always possible that some of the menus may be incorrectly priced. If the correct price for an order is higher than the price stated on the Website, Dibrail will normally contact you before the order in question is dispatched. Dibrail is under no obligation to ensure that the order is provided to you at the incorrect lower price or to compensate you in respect of incorrect pricing.
  • 5.3 Payment for all orders must be by credit or debit card as stated on this Website or in cash at the point of delivery to you.
  • 5.4 If you choose online payment, you must pay for your order before it is delivered. To ensure that shopping online is secure, your Debit/Credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet. Your Debit/ Credit card company may also conduct security checks to confirm it is you placing the order.
  • 5.5 We run different types of Promotional Code or Discount Coupon or Offers on our Website. You can take advantage of our Discount offers at the time of ordering. Please read the all terms & conditions of our Promotional Code or Discount Coupon or Offers before using it.
  • 5.6 Please note that from time to time there may be delays with processing payments and transactions, on occasion this can take up to sixty (60) days to be deducted from your Bank Account.

Delivery Proces

  • 6.1 Delivering the food items ordered on this Website is the sole responsibility of the Restaurant in the stipulated time with proper Packing & Hygiene.
  • 6.2 We try our best in coordinating delivery of the orders with the restaurants, but however if in an unfortunate situation the said delivery fails, then we request the customers to get in touch with us immediately, and we will try to arrange the delivery at the next available upcoming station. Moreover, we too take a very close watch at all the deliveries, and ourselves arrange for deliveries at upcoming stations, but it becomes very helpful when customers themselves notify us of any such occurrence.
  • 6.3 At the time of customer’s unavailability to accept the order at the time of delivery, or if the customer is unavailable at the mentioned coach and seat number, or if you are unable to communicate to us your updated coach and seat number (only in case of W/L or RAC situations), then such orders shall be deemed to have been delivered to you and all risk and responsibility in relation to such deliveries shall pass on to you. Any costs which we incur as a result of the inability to deliver shall be your responsibility of the customer and therefore shall indemnify us in full for such cost.
  • 6.4 Restaurants delivering the orders will aim to Deliver the exact order (Goods or Services) to you at the Train seat/coach requested by you within the stoppage time at that Particular Station chosen by you.
  • 6.5 Delivery Restaurants and we shall not be liable to you for any Losses, Liabilities, Costs, Damages, Charges or Expenses arising out of late Delivery.
  • 6.6 All risks in the Food Delivery shall pass to you upon delivery.

Cancellation Policy and Refund Policy

  • 7.1 You can cancel your order up to the order Cut-off time. You can Cancel your order either by calling our call centre number, or through our Website. You will need to quote your Mobile phone number and order ID to cancel the order. You may be required to Login on the website in order to cancel Your Order, where applicable. We will not be able to Cancel any order after order Cut-off time, which is usually up to 2 hours before the actual Pre-determined Delivery timings
  • 7.2 In the interest of the Customer’s Privacy and Genuineness of the Cancellation, we would prefer to cancel orders only if requests come from the mobile numbers used for order bookings along with the order ID or through registered customer user Ids. However, if the customer is unable to access both the tools, then our team would first verify the customer through some basic Questions and then process the Cancellations.
  • 7.3 We allow our customers to Cancel their orders up to 2 hours before the actual pre-determined delivery timings between 9am to 9pm on any working day. For example – If your actual pre-determined delivery time is 6pm, then you may cancel your order on or before 4pm on the Same Day. However if your delivery time is 9.30am, then you’ll have to do the same on or before 9pm on a day before.
  • 7.4 The cut off time in terms of Bulk / Group orders is 12 hours before the Scheduled Delivery Time.
  • 7.5 Any change in order will apply Cancellation of the Original order, and hence a New Order ID will be Generated.
  • 7.6 An SMS will be sent to the customers in the event of cancellations of orders at the mobile number shared by the customer with Dibrail. In the event that no SMS is received, customers are advised to call our helpline number for confirmations.
  • 7.7 In the unlikely event that the Delivery Restaurant delivers a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item. If the Delivery Restaurant can only do a partial delivery (a few items might be not available), its staff should inform you or propose a replacement for missing items. You have the right to refuse a partial order before delivery and get a refund. We will put our best effort in ensuring that the delivery is complete and as per your order, however this may not be possible in all cases.


  • Refund Policy


    If the payment is made by the customer in advance then he may be eligible for refunds as per following terms.

  • 7.8 Orders Cancelled before 24 hours of Scheduled Delivery time will be eligible for 100% Refunds within 10 working Days.
  • 7.9 Orders cancelled between 24 hours and before 2 hours of Scheduled Delivery time, then we’ll reimburse the entire amount within 10 working Days after deducting 10% order Cancellation Charges.
  • 7.10 No order will be cancelled post 2 hour cut off time, and therefore no refunds.
  • 7.11 In the event of no show from the customer at the time of delivery, then it’ll be treated as Cancelled post 2 hour cut off time and customers will not be Eligible for any Refund.
  • 7.12 In case of all orders booked by customers themselves through our website, all Refunds would take place in the Accounts used by Customers for Order Booking.
  • 7.13 In case of all orders booked through our Authorised Agents, all refunds will be available from the same agent only.


  • Refund on Cancellations on Prepaid Bulk / Group Order Bookings


    We provide additional discounts for bulk / group order bookings to our customers, and moreover we believe that our customers would too understand that it takes a lot of preparation and coordination for delivering food to a large number of people. Therefore, if the payment is made by the customer in advance then he may be eligible for refunds as per following terms

  • 7.14 Any change in Group order will apply Cancellation of the Original order, and hence a New Order ID will be Generated.
  • 7.15 The cut off time in terms of Bulk / Group orders is 12 hours before the Scheduled Delivery Time.
  • 7.16 Orders Cancelled before 24 hours of Scheduled Delivery time will be eligible for 100% Refunds within 10 working Days.
  • 7.17 No order will be cancelled post 12 hour cut off time, and therefore no refunds.Orders cancelled between 24 hours and before 12 hours of Scheduled Delivery time, then we’ll reimburse the entire amount within 10 working Days after deducting 10% Order Cancellation Charges.
  • 7.18 In the event of no show from the customer at the time of delivery, then it’ll be treated as cancelled post 12 hour cut off time and customers will not be eligible for any refund.
  • 7.19 Dibrail reserve the rights to cancel any order without assigning any reason in various cases but not limited to the following reasons where train are delayed, customer is not reachable, any orders placed using promotional coupon, misuse of promotional coupon, unauthorised usage of coupon or inaccuracies of coupon pricing, technical glitches and value thresholds, changes in food menu, menu and pricing issue, serving restaurant is closed etc. However, Dibrail's first priority is customers and Dibrail will do a maximum of three attempts to update customers on phone and Dibrail will strive to deliver food.

  • 8.1 You are permitted to Print and Download extracts from this Website for your own personal use on the following basis:
  • A- Unless otherwise stated, the Copyright and other Intellectual Property Rights in this Website and in Material Published on it (including without limitation Photographs and Graphical Images) are owned by Dibrail or Dibrail’s licensors. These works are protected by Copyright laws and treaties around the world and all rights are reserved.
  • B- You must not modify the Digital or paper copies of any Materials that you print off and you must not use any Pictures, Photographs or any other Graphics, Video or Audio sequences Separately from any Accompanying Text.

Without Dibrail’s prior permission, you agree not to display or use in any manner the Dibrail.com Intellectual Property Rights which include Trademark and Copyrights in Artistic work, Literary, Software and Cinematographic Representations.

Termination

  • D. Contains Viruses or any other Harmful Programs.
  • 14.2 Upon termination or suspension you must immediately Destroy any Downloaded or Printed extracts from this Website.

Liability

  • 15.1 Dibrail, and any of our Group Companies and the Officers, Directors, Employees, Shareholders or Agents of any of them, Exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including any Direct, Indirect, Punitive or Consequential Loss or Damages, or any Loss of Income, Profits, Goodwill, Data, Contracts, or Loss or Damages Arising from or connected in any way to business interruption, Loss of opportunity, loss of anticipated savings, Wasted management or office time and whether in tort (including negligence), Contract or otherwise, even if foreseeable) in connection with our Services, this Website or in connection with the use, inability to use or the results of use of this Website, any websites linked to this Website or the Material on these websites.
  • 15.2 Dibrail takes full responsibility for the content of this Website and for the communication of orders to the Delivery Restaurants as set out in these Website Terms. Dibrail’s customer care team will, subject to your compliance with these Website Terms and cooperation, use all reasonable Endeavours to resolve any issues arising from the submission of orders via this Website including the processing of all credit or debit card refunds and chargebacks where appropriate. However, please note that the legal contract for the supply and purchase of food and beverages is between you and the Delivery Restaurants that you place your order with. Dibrail cannot give any undertaking that the food and beverages ordered from the Delivery Restaurants through this Website will be of satisfactory quality and any such warranties are disclaimed by Dibrail. These disclaimers do not affect your statutory rights against the Delivery Restaurants.
  • 15.3 Nothing in these Website Terms excludes or limits our liability for death or personal injury arising from Dibrail’s negligence, nor Dibrail’s liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law. Nothing in these Website Terms affects your statutory rights.
  • 15.4 With the exception of any liability referred to in paragraph 15.3 above, Dibrail’s total liability to you in relation to your use of the Website and the services that we provide including (but not limited) to liability for breach of these Website Terms and tort (including but not limited to negligence) is limited to an amount equivalent to trice the value of your order or three thousand Indian rupees, whichever is the lower.
  • 15.5 If your use of material on this Website results in the need for servicing, repair or correction of equipment, software or data, you assume all associated costs.

Governing Law and Jurisdiction

  • 16.1 This Agreement and the relationship between you and www.dibrail.com shall be governed by the laws of the Republic of India without regard to its conflict of law provisions. You and dibrail.com agree to submit to the personal and exclusive jurisdiction of the courts located at Begusarai , Begusarai District , Bihar state, India.
  • 16.2 These website Terms & Conditions shall be governed and construed according to Indian Law. Disputes arising in connection with these Website Terms (including Non-contractual Disputes) shall be subject to the exclusive jurisdiction of the courts of Begusarai (Bihar). All dealings, correspondence and contacts between us shall be made or conducted in the English Language.

Events Outside Our Control

  • B. Civil Commotion, Riot, Invasion, Terrorist Attack or Threat of Terrorist Attack, War (whether declared or not) or threat or Preparation for War;
  • C. Fire, Explosion, Storm, Flood, Earthquake, Subsidence, Epidemic or other Natural or Artificial Disasters;
  • D.Impossibility of the use of Railways, Shipping, Aircraft, Motor Transport or other means of Public or Private Transport;
  • E. Impossibility of the use of Public or Private Telecommunications networks; and
  • F. The Acts, Decrees, Legislation, Regulations or Restrictions of any Government.
